OREANDA-NEWS. May 05, 2009. In April 2009, "Metallorukav" CJSC and "Metallorukav" Trading House" Ltd. transferred to the federal budget more than 148,000 Rubles imposed as administrative fines for abusing dominant position on the market of metal braiding for pipelines use in manufacturing of rocket engines, reported the press-centre of FAS Russia.

In September 2008, FAS Russia processed the antimonopoly case and found that the group of persons including "Metallorukav" CJSC and "Metallorukav" Trading House" Ltd. violated Part 1 Article 10 of the Federal Law "On Protection of Competition".

The group of persons violated the law by abusing dominant position on the market of metal braiding for pipelines use in manufacturing of rocket engines; in particular, in 2007 - 2008 "Metallorukav" Trading House" Ltd. fixed and maintained monopolistically high prices for metal braiding for pipelines of certain grades, and "Metallorukav" CJSC refused to conclude a contract for supplying metal braiding for pipelines of certain grades with "PROTON-Permskie Motory" OJSC without any economic or technological justification and despite a possibility for manufacturing and supplying the products.

"PROTON-Permskie Motory" OJSC manufacturers rocket engines and components to them. "PROTON-Permskie Motory" OJSC supplies the manufactured rocket engines, in particular, under the governmental contracts; which means that the company acts as an executor of state defence orders.

Under Article 14.31 of the Code of the Russian Federation on Administrative Violations, abusing dominant position constitutes the grounds for imposing an administrative fine. Article 14.31 specifies the punishment for antimonopoly violations in the form of a fine from one hundredth to fifteen hundredth of the total proceeds of the violator gained by selling the goods on the market where the violation was committed, in the year preceding the year when the violation was discovered.
