OREANDA-NEWS. October 05, 2009. The Office of the Federal Antimonopoly Service in St Petersburg (the St Petersburg OFAS Russia) found that "Energia Holding" Ltd. violated Article 10 of the Federal Law "On Protection of Competition". The antimonopoly case against the company was initiated upon a petition of a homeowners association ("Penaty" TSZh) about the actions undertaken by the provider of last resort when applying the electric power tariffs, reported the press-centre of FAS Russia.

"Energia Holding" Ltd. is the provider of last resort in St Petersburg.

"Penaty" TSZh executes utility services of power supply in a housing development for individual residential construction (a gated community). The project documents for the housing development include installation of stationary electric stoves in residential houses.

According to the instructions of the St Petersburg Tariff Committee, "Penaty" TSZh belongs to a group of consumers - executors of utility services, who buy electric power for communal and household consumption by the residents of houses with stationary eclectic stoves. For such customer category the rate is fixed at 130 kopecks /kW.h.

However, "Energia Holding" Ltd. made payment arrangements with "Penaty" TSZh using the tariffs fixed for a group of consumers - executors of utility services that buy electric power for communal and household use by the residents of houses with gas stoves. In this case the tariff is .185 kopecks /kW.h. Those actions lead to infringing the interests of the homeowners association.

The St Petersburg OFAS Russia issued a determination to "Energia Holding" Ltd. to stop the violations.
