OREANDA-NEWS. March 15, 2010. The Antimonopoly Committee of Ukraine calls on the Ministry of Transport and Communications of Ukraine to stop anticompetitive actions in the form of impeding the implementation of dredging works by “NIBULON” in the waters of Mykolayiv Port. According to the adopted in this case decision of the Antimonopoly Committee, the Ministry of Transport and Communications of Ukraine should satisfy obligations in a month’s time.

Firstly, the Ministry of Transport and Communications of Ukraine has to reverse the decision, that denied implementation of dredging works to “NIBULON”.

Secondly, it has to re-examine the materials provided by the company and to decide their approval.

Thirdly, the Ministry of Transport and Communications of Ukraine is obliged to refrain from creating unjustified obstacles during the implementation of dredging works by “NIBULON”.
“Anticompetitive actions of the Ministry of Transport and Communications of Ukraine in Mykolayiv Commercial Sea Port that are known far beyond our country are spoiling the image of Ukraine as a global player in the grain market. The decision of the Antimonopoly Committee of Ukraine is directed towards putting an end to such a behavior”, - acting head of the Antimonopoly Committee of Ukraine, Alexander Melnychenko commented on the results of the case.

Instead, the representatives of the Ministry of Transport and Communications of Ukraine, who were officially invited, did not appear on the meeting of the Antimonopoly Committee of Ukraine.

As it was previously reported, the Antimonopoly Committee of Ukraine gave recommendations to the Ministry of Transport and Communications of Ukraine concerning removal of obstacles for the implementation of “NIBULON’s” dredging works on leased land within the water area adjacent to the company’s berths in Mykolayiv. According to the conclusions of the Antimonopoly Committee of Ukraine, actions of the Ministry of Transport and Communications create unequal conditions for enterprises that compete, working at the market of grain and oilseeds transshipment within the bounds of Mykolayiv port.
