OREANDA-NEWS. April 21, 2010. The Federal Antimonopoly Service (FAS Russia) initiated a case against "Rexam Beverage Can Naro-Fominsk" Ltd. and "Baltika" Brewing Company" OJSC for the signs of violating Part 2 Article 11 of the Federal Law "On Protection of Competition", reported the press-centre of FAS Russia.

FAS Russia suspects that "Rexam Beverage Can Naro-Fominsk" Ltd. and "Baltika" Brewing Company" OJSC violated the law because in 2006 the companies entered into an agreement which determines general circulation conditions of 1.0 liter aluminum can. Under the agreement the buyer undertakes not to sell this product in the Russian Federation, Ukraine and the Republic of Belarus to any other buyer that produces beer in these regions.

Also under the agreement "Rexam Beverage Can Naro-Fominsk" Ltd. refuses to pursue independent distribution of 1-liter aluminum can because distribution of this product in the above regions requires approval of "Baltika" Brewing Company" OJSC. At the same time "Rexam Beverage Can Naro-Fominsk" Ltd. and "Baltika" Brewing Company" OJSC are not members of the same group of persons.

"SAN InBev" OJSC and "Moscow Brewing Company" CJSC are brought into the proceedings as interested persons.

The case will be heard on 20th May 2010.
