OREANDA-NEWS. March 1, 2011. The Russian Federal Antimonopoly Service (FAS of Russia) has established in its Decision of February 17, 2011 that the aggregate share of JSC Chelyabinsk Zinc Plant ("CZP") in the Russian zinc market is less than 20%.

Pursuant to Article 5.2 of the Federal Law on Protection of Competition, no business entity may be considered as having a dominant position in a certain commodity market if its share in such market is less than 35%. Therefore, CZP does not have a dominant position in the zinc market of the Russian Federation.

Accordingly, the restrictions provided by Articles 10.1(6) and 10.1(8) of the Federal Law on Protection of Competition are not applicable to CZP.
