OREANDA-NEWS. September 22, 2011. A meeting with representatives of condominium partnerships was held hosted by the Thermal Energy Marketing Administration of JSC “Yenisei TGC (TGC-13)”. Jointly with representatives of the Court Bailiffs Service, specialists of the energy company offered executives of housing management companies consultation on organization of work with debtors.

This is one of the first events within the framework whereof all the three parties, power industry specialists, bailiffs, and housing management organizations joined their efforts for work with debtor residents that are end consumers of energy resources. At the meeting lawyers and representatives of the Thermal Energy Marketing Directorate of Yenisei TGC and the Court Bailiffs service explained to condominium partnerships executives the procedure of pre-trial preparation, judicial proceedings and enforcement applicable to tenants delaying payment of utility charges.

The newly received knowledge will help executives of housing management companies initiate and follow up the whole array of measures for work with their debtors. This means that residents delaying payment of utility charges will bear responsibility for their actions in accordance with the established legislation. Penalty sanctions applied to them will vary from limitation of foreign travel right to arrest of property and movement into smaller size apartments. Additionally, the law stipulates that the creditor (represented in this case by the managing company or condominium partnership) is entitled to claim collection of interest for use or detention of money (Article 395 of the Civil Code of the Russian Federation).

Cooperation of power industry specialists with housing management organizations in solution of the energy resources debt redemption problem is important for the both parties. In most cases indebtedness of condominium partnerships and managing companies to energy resources suppliers are due to low payment discipline of the population. Assisting housing management organizations in work with debtors, Yenisei TGC is entitled to expect from such organizations payment timeliness.

At the meeting one decided to take joint actions such as sweeps of houses residents whereof are debtors to condominium partnership undertaken by housing management companies executives and representatives of the Thermal Energy Marketing Administration of JSC “Yenisei TGC (TGC-13)” as well as proceed with arrangement of such consulting meeting. Additionally, “Yenisei TGC” specialists declared their preparedness to provide legal support to all executives of condominium partnership and managing organizations that may resort to the energy company for advice on work with debtors.

Besides, “Yenisei TGC” strongly recommends that all consumers of thermal energy promptly redeem their indebtedness and henceforth avoid delays in payment for energy resources supplied: this will prevent legal proceedings, court bailiffs’ visits as well as additional expenditures associated with legal costs, penalty sanctions and charges for use or detention of money.
