OREANDA-NEWS. June 25, 2014. Deputy Head of FAS, Andrey Tsyganov, who led a delegation of Russian antimonopoly authority at the sessions of the Competition Committee of the Organization for Economic Cooperation and Development (OECD) in Paris, made a presentation on 2013 Report on Competition Policy in the Russian Federation.

Andrey Tsyganov highlighted the most important FAS achievements in 2013, both in improving the competition law and enforcement in various markets, specially emphasizing significance of signing the Treaty on establishing the Eurasian Economic Union, which, in particular, has a system of legal norms regulating relations in the field of competition:

“Provisions of the new Treaty provide for continuity and develop the rules of antimonopoly control on cross-border markets described in the Agreement on the common principles and rules of competition”.

Andrey Tsyganov specially focused on adopting the Model Competition Law by Kazakhstan, Belarus and Russia that determined the basic principles of common competition policy of the three countries at the national level, so it would be comfortable for business to enter the markets in these countries under harmonized national laws.

The Committee also organized a Round Table on “Generic Drugs”. Round Table participants exchanged experience on government regulation and generic drugs registration, and discussed the role of competition in supporting entry of new drugs to the market.

During the discussion, Andrey Tsyganov emphasized that FAS is convinced in possibility to resolve most of problematic issues related to violations by pharmaceutical companies and distributors as well as state and municipal bodies and medical community, although it will require time and efforts: “They will be resolved through consistent implementation of the legal standards, obligating the ordering parties to form separate lots for each purchased drugs with International Non-Proprietary Names (INN), as well as purchase drugs only according to INN. These standards are provided for by the Federal Law on contractual system. A relevant section of the Road Map for developing competition should also be fully implemented”.
