OREANDA-NEWS. August 26, 2014. The Arbitration Court of the North-Caucasus District confirmed legitimacy of the decision issued by the Office of the Federal Antimonopoly Service in the Krasnodar region (Krasnodar OFAS Russia) with regard to “NESK-Elektroseti” OJSC. As a result of the judicial proceedings, the company was held administratively liable and fined 1,399,274.3 RUB.

In October 2012, Krasnodar OFAS Russia found that “NESK-Elektroseti” OJSC abused market dominance (Part 1 Article 10 of the Federal Law “On Protection of Competition”). OFAS issued a determination to eliminate the violation because the network company had supplied electric power of inadequate quality to a residential house; therefore, infringing consumer interests.

“NESK-Elektroseti” OJSC disagreed with the decision of the antimonopoly body and filed a lawsuit to Krasnodar Regional Arbitration Court.

The Arbitration Court dismissed the claim of “NESK-Elektroseti” OJSC and pronounced legitimacy and reasonableness of the decision of Krasnodar OFAS Russia. The 15th Arbitration Appeal Court and the Federal Arbitration Court of the North-Caucasus District also supported the OFAS position.
