OREANDA-NEWS. September 13, 2010. The draft federal law makes amendments to the Russian Federation Criminal Procedural Code and the Federal Law On Detention of Persons Suspected or Accused of Committing Crimes.

The draft law aims at guaranteeing the constitutional rights of persons suspected or accused of committing crimes against life and health.

The relevant articles in the Criminal Procedural Code contain provisions making it possible to impose milder preventive measures and take into account a number of circumstances when choosing the appropriate measures, including serious illness of the suspected or accused person and their resulting state of health. But the current legislation does not specify the exact grounds for taking milder measures.

The draft law would amend the Criminal Procedural Code making it possible to take measures other than detention in custody if the person suspected or accused of a crime is found to have an illness incompatible with detention in custody, which illness is certified by a medical diagnosis made following the necessary medical examinations.

The Government will draft and approve a list of serious illnesses and procedures for medical examination and official diagnosis.
